Terms of Use

You should carefully read the following Terms of Use before using our services. Unless you have different Terms of Use signed by Hunin Software, your use of our services indicates your acceptance of these terms.

• No Contract
  There is no contract or commitment required to use the Community Builder services and you may terminate your account at any time.
  
  
• Cancelling Your Account
  You may cancel your account at any time. To do so, visit the General / Subscriptions / Service List page of your Control Panel and click the "Terminate This Account!" button. However, any payments made to Hunin Software prior to cancelling your account are non-refundable.
  
  
• Abuse of Services
  Any use of the services to abuse another user, violate a user's privacy, commit illegal activity, violate the security of the Hunin Software website, or any other such action that Hunin Software deems inappropriate may result in action up to and including immediate termination of your account.
  
  
• Resale of Services
  Any attempt to resell any of our services without the direct written consent of Hunin Software will result in the immediate termination of your account.
  
  
• Confidentiality
  Hunin Software considers all of your account information to be confidential and will not divulge any of your information to anyone except our designated account administration and billing representatives. Your confidential information will not be given to any other company under any circumstances.
  
  
• Copyright Notice
  All copyright and "Powered by" notices at the bottom of the pages must be visible by all visitors to the services you subscribe to. You are not permitted to use any means to remove this information prior to display on your site.
  
  
• Feature Availability
  By agreeing to these Terms of Use, you acknowledge that access logs, detailed site tracking, will not be available. You will be able to check the page views per month and the current record count via your Control Panel.
  
  
• Indemnity
  You agree to indemnify and hold harmless Hunin Software against any claims, actions, lawsuits, liabilities, etc. due to violation of these Terms of Use or misuse of our services by you or any of your users.
  
  
• Warranty
  OUR SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which our services may be used, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. YOU ARE SOLELY RESPONSIBLE FOR ALL USE AND CONFIGURATION OF THE SERVICES YOU SUBSCRIBE TO.
  
  
• Disclaimer
  YOU MUST ASSUME ALL RISK ASSOCIATED WITH USING OUR SERVICES INCLUDING BUT NOT LIMITED TO THE CONDUCT/ACTIVITY OF YOUR USERS. HUNIN SOFTWARE IS IN NO WAY LIABLE FOR ANY LOSS OF DATA OR DAMAGES OF ANY KIND INCURRED DUE TO USE OR MISSUSE OF OUR SERVICES.
  
  
• Changes to these Terms
  Hunin Software reserves the right to make changes to these Terms of Use and it is your responsibility to be aware of these changes.
  
  
• Provisions
  The terms set forth herein constitute the final agreement between you and Hunin Software regarding use of Hunin Software's Community Builder services. If any of these terms should be found unenforcable, the remaining terms will still remain in effect and in full force.
  
  
• Billing Date
  Your billing date will be the day of the month that you sign up. If the billing day exceeds the number of days in the month, you will be billed on the last day of that month. For example, if you signed up on January 31 and the current month is February, you will be billed on the 28th.
  
  
• Payments
  All payments made to Community Builder are non-refundable. This includes all donations made via the "Community Chest" feature.
  
  
• Failure to Make Payment
  Failure to make payment (invalid credit card information, insufficient funds, etc.) will result in a warning being emailed to the administrator. Another attempt will be made 7 days later. If this second attempt fails, your account will be disabled pending a successful payment. All accounts left unpaid after 3 months are subject to termination.
  
  
• Credit Card Fraud
  Hunin Software prosecutes all credit card fraud to the fullest extent of the law!
  
  
• Usage Limitations
  You are entitled to 20,000 page views per month. If the number of page views exceeds your limit, you will be charged $4 per each additional 20,000 page views. All broadcast emails sent from your organization administrators (via the Control Panel) will be counted as 10 page views. These overage fees are merely to recoup the costs of very high-trafic communities (most communities will never see overage fees) and you are free to go over these limits as needed. Just be aware of these overage fees.
